| 1. Introduction | |
| These Terms and Conditions (“Terms”) govern all photography services provided by Brandon Schuster Photography (“Photographer”) to the Client. By commissioning services, the Client agrees to be bound by these Terms. | This is the rulebook. If you hire me, you agree to these terms. |
| 2. Booking & Payment | |
|
2.1 A booking is confirmed upon receipt of a 40% retainer. 2.2 The balance is due within 30 days of invoice. 2.3 Early payment discount: 1% if paid within 14 days. 2.4 Payment is accepted via IBAN bank transfer. |
To lock in your shoot, pay a 40% deposit. The rest is due within 30 days. Pay early (within 14 days) and you get 1% off. Bank transfer only. |
| 3. Copyright & Licensing | |
|
3.1 Copyright remains the property of the Photographer under the Copyright and Related Rights Act 2000. 3.2 The Photographer asserts his moral right to be identified as author. 3.3 Upon full payment, Client receives a perpetual, non-exclusive licence to use Images for their own marketing (web, social, PR, brochures, ads). 3.4 The licence is non-transferable: Images may not be sublicensed, resold, or passed to third parties. 3.5 For agency-commissioned work or campaigns with significant paid media spend, extended licensing terms may apply by separate agreement. |
I keep copyright (standard). You get unlimited use for your marketing: website, socials, PR, brochures, ads. You can’t sell or pass them on. If it’s a big agency job or huge ad campaign, we’ll agree extra terms. |
| 4. Cancellations & Postponements | |
|
4.1 Cancellation 15+ days before the shoot: Full refund of the retainer. 4.2 Cancellation within 14 days: Retainer is forfeited. Remaining balance is waived. 4.3 One postponement is permitted without penalty if requested at least 7 days in advance, subject to Photographer’s availability. The rescheduled date must be within 3 months. |
Cancel 15+ days before = full refund of deposit. Cancel within 14 days = I keep the deposit but you don’t owe the rest. You can move the date once if you give me a week’s notice and rebook within 3 months. |
| 5. Delivery & Storage | |
|
5.1 Images are delivered via secure online gallery with download link and PIN. 5.2 Galleries remain available for 30 days. 5.3 Optional extended storage: €100/year for 20GB. |
You’ll get your photos in an online gallery with a PIN. The link stays live for 30 days. Need them kept longer? I offer storage (€100/year for 20GB). |
| 6. Revisions | |
|
6.1 One round of light revisions per image is included. 6.2 Revisions exclude retouching of conditions outside the Photographer’s control (e.g., uncleaned spaces, property damage). 6.3 Additional revisions are billed at €40/hour. |
One round of tweaks per image is included. Retouching dirt, damage, or anything outside my control isn’t. More changes cost €40/hour. |
| 7. Client Responsibilities | |

7.1 Client must ensure location is clean and photography-ready. 7.2 Time spent cleaning/staging reduces available shooting time and may be billed at €40/hour. 7.3 Client is responsible for obtaining all necessary property and model releases. 7.4 Client indemnifies Photographer against claims arising from missing permissions or misuse of Images. |
Have the space ready when I arrive. If I end up cleaning, that’s less time for photos and may cost extra. You’re responsible for getting permissions (people, property). If claims arise, it’s on you, not me. |
| 8. Liability & Insurance | |
|
8.1 Photographer holds public liability insurance up to €7,000,000. 8.2 Photographer is not liable for indirect, incidental, or consequential damages. 8.3 Liability is limited to the total fees paid by Client for the specific assignment. |
I’m insured for up to €7 million. I’m not liable for knock-on effects if something goes wrong. At most, my liability equals what you paid me. |
| 9. GDPR & Data Protection | |
| Photographer complies with the General Data Protection Regulation (GDPR). Personal data is processed lawfully, fairly, and securely, and used only as necessary for providing services and maintaining records. | I follow GDPR. Your data is safe, only used for what’s needed to deliver and manage your project. |
| 10. Governing Law & Disputes | |
| These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts. | Irish law applies. If we ever have a dispute, it’ll be handled in Irish courts. |
