| 1. Copyright Ownership | |
| All photographs created by Brandon Schuster Photography are protected under the Irish Copyright and Related Rights Act 2000. Copyright remains the exclusive property of the Photographer at all times. | I hold the copyright on all my photos by law. You get a licence to use them as you need — the pictures remain mine, but the usage is yours. |
| 2. Licence Granted | |
| Upon full payment, Clients receive a perpetual, non-exclusive, non-transferable licence to use the Images for their own business marketing, including websites, social media, PR, printed brochures, and paid advertising. Extended licences may apply for high-value campaigns or third-party use. | Once you’ve paid, you can use the photos forever for your own marketing: websites, socials, brochures, ads. If it’s a massive ad campaign or you want to pass them to others, we’ll chat about extra licensing. |
| 3. Credit & Moral Rights | |
| The Photographer asserts his moral right to be identified as the author of the Images. Credit (© Brandon Schuster Photography) is requested where reasonably practical, especially in editorial or press use. | Please credit me when you can, especially in press or editorial features. In ads, it’s not expected — but it’s always appreciated. |
| 4. Prohibited Uses | |
| Images may not be resold, sublicensed, or transferred to third parties without the Photographer’s prior written consent. Alterations that distort the integrity of the Images are not permitted. | You can’t sell my photos, give them away, or heavily mess with them without asking me first. |
| 5. Portfolio & Promotional Rights | |
| The Photographer retains the right to use the Images for the purposes of advertising, marketing, and promoting their work and services. This includes, but is not limited to, use in the Photographer's print and online portfolio, on their website and social media channels, in studio displays, and for entry into photographic competitions or exhibitions. The Photographer will exercise reasonable discretion to safeguard any confidential or sensitive information that may be depicted within the Images. Where Images are created as part of a campaign with a specific launch date, the Photographer agrees to withhold promotional use until after said date. | I can use the photos I took for you in my own portfolio, on my website, social media, and for competitions. I'll always be discreet with any sensitive info, and I'll wait to share them until after your official launch date. |
| 6. Governing Law & Jurisdiction | |
| This Agreement shall be governed by and construed in accordance with the laws of Ireland, and the parties irrevocably submit to the exclusive jurisdiction of the courts of Ireland to settle any dispute or claim arising out of or in connection with this Agreement. | We're both covered by Irish law. If we ever have a major disagreement that requires legal action, it will be handled exclusively in an Irish court. |
| 7. Breach & Termination of Licence | |
| Any failure by the Client to comply with the terms of this Agreement, including but not limited to failure to make full payment, shall constitute a breach. Upon such a breach, the licence granted herein shall be immediately and automatically revoked. The Photographer reserves the right to take any legal action necessary to enforce their copyright and prevent further unauthorised use of the Images. | If you break these rules (like not paying or giving the photos away without permission), your licence to use them is cancelled immediately, and I can take action to stop you from using them. |
| 8. Indemnification | |
| The Client agrees to indemnify and hold harmless the Photographer against any and all claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of the Client’s use of the Images. | If you use my photo in a way that gets *you* sued (for example, in a controversial ad), you agree that I am not held responsible for any of your legal costs or trouble. |
| 9. RAW Files & Editing | |
| The selection and editing of Images are at the Photographer's sole discretion. The Photographer does not release unedited, RAW, or original digital files to the Client under any circumstances. The licence granted herein applies only to the final, edited Images provided to the Client. | I'll never send you the unedited or RAW files. My creative process includes the final edit, and that's the finished product you get the licence for. |
